New Changes to Florida’s Officer Surgery Rules: Failed Inspections and the Impact on Your Practice

Our office continuously monitors Florida Board of Medicine activities for changes in Florida’s office surgery laws and rules. We always recommend that office surgery facility owners, designated physicians, and surgeons do so as well because changes in laws or rules can drastically impact on your practice, especially if you are unaware of the impacts.

Florida registered office surgery facilities are annually inspected; the vast majority are inspected by the Department of Health (DOH), while some nationally accredited facilities are inspected by the accrediting agency. The rule change discussed in this blog is particularly relevant to those facilities that are inspected annually by the DOH.

Rule 64B8-9.0091, F.A.C. (Requirements for Physician Office Surgery Registration; Inspection or Accreditation) has been changed by the Florida Boards of Medicine and Osteopathic Medicine, and the new changes become effective on March 2, 2026.  The new changes state that the facility and the designated physician may be referred to the Department of Health for disciplinary action when:

  1. A Florida registered office surgery facility fails an annual inspection, AND
  2. The following year’s annual inspection includes the same violations.

Previously, a Florida registered office surgery facility that failed an inspection had 30 days to submit a Corrective Action Plan (CAP) without further action. This rule change aims to reduce the number of continued failed inspections, often failing for the same reasons, by office surgery facilities.

The impact on your practice is as follows: it is imperative that your registered office surgery facilities pass their annual inspection. Owners and Designated Physician must understand the repercussions of not being fully prepared for an annual inspection. You can avoid the detriment and stress of having a complaint filed against your office surgery registration and/or medical license.
