Florida’s New Health Law Opens Licensing Pathway for Physicians with NPDB Reports

One of the most significant changes in Florida Health Law this year came on June 2, 2025, when Governor Ron DeSantis signed House Bill 1299 into law, a major shift that will affect physicians whose National Practitioner Data Bank (NPDB) reports contain disciplinary “hits.”
Background: A Reversal on Licensing Restrictions
In 2024, Florida lawmakers implemented a strict policy that barred physicians from obtaining a license if they had any “hit” on their NPDB report, regardless of the underlying circumstances. That restriction left many well-qualified physicians unable to practice in Florida due to past incidents that may not have constituted actual violations under Florida law.
With the passage of HB 1299, Florida has reversed course, providing a new licensure pathway for these professionals.
What the New HB 1299 Law Says
Effective July 1, 2025, the new law allows the Florida Board of Medicine and the Board of Osteopathic Medicine to evaluate the specific circumstances behind NPDB entries. If the conduct that led to the NPDB report does not constitute a disciplinary violation under Florida law, the Boards are empowered to:

Grant a full license,

Grant a license with conditions, or

Deny the application based on their assessment.
This flexibility allows Florida to review applicants more holistically, considering both public safety and professional rehabilitation, while addressing Florida’s ongoing physician workforce needs.
