Facing DBPR Administrative Complaint in Florida? Here’s What to Do.
February 12, 2018 | By Jeff HowellThe Department of Business and Professional Regulation (DBPR) is the state agency, located in Tallahassee, Florida, which licenses and regulates businesses and professionals in the State of Florida. Our law firm focuses on the representation of business licensees and their facilities before DBPR. The DBPR regulates alcohol and tobacco licenses, hotels and restaurants, real estate agents, barbers, and cosmetologist, amongst others.
We advise companies and professional licensees with the initial application process for licensure, change of ownership issues, and renewal and expiration issues. In addition, we represent clients who have received a DBPR Administrative Complaint or other forms of discipline issued by DBPR.
DBPR Administrative Complaints
Complaints can originate from a variety of sources, such as competitors, unhappy clients or customers, or from DBPR itself during regular inspections. If you have received a letter or other communication from DBPR, do not go at it alone. DBPR and its employee’s goals are to protect the public. Do not make the mistake of thinking DBPR is there to assist you. Once a complaint has been originated, this can lead to an investigation and eventually an Administrative Complaint. The Administrative Complaint shall be issued by DBPR per Florida Law.
Do not take the filed complaint lightly. Once you receive an Administrative Complaint, you only have twenty-one (21) days to respond. As a Florida Professional Licensee, you waive your rights to challenge the agency’s Administrative Complaint if you do not respond within the twenty-one (21) days. Waiving your rights could lead to severe penalties.
