Florida Pharmacists: Dispensing Drugs Without Prescription

We all make mistakes, but if you are a licensed pharmacist in the state of Florida and dispense drugs without a prescription, you may not only be sued civilly and face criminal charges, you can face additional administrative fines in the amount of $10,000 for each offense and lose your license, and with it your ability to earn a living.

According to Sections 465.015(2)(c) and 465.016(1)(r), Florida Statutes, the Florida Board of Pharmacy may discipline your license if you sell or dispense prescription drugs without being furnished with a prescription. According to Rule 64B16-30.001(2)(e)f, Florida Administrative Code, the penalty for a first violation is a $1,500 fine if the dispensed drug is not a controlled substance, and a $5,000 fine and one-year probation if the substance is controlled. If you have a prior disciplinary history, the stipulated penalties are a $5,000 fine and one-year probation for a non-controlled substance and a $10,000 fine and suspension or revocation of your license for a controlled substance. Your disciplinary history is a matter of public record, and will be viewable by patients and prospective employers.

However, these penalties are not set in stone. The Board of Pharmacy can take into account any number of aggravating or mitigating factors to increase or lesson the penalties set down in the rules.
